Terms of Service

1. Agreement
By engaging Nexsus for any service, you agree to these terms. Custom project agreements override these terms where they conflict.
2. Scope of work
Each project is governed by a written scope and quote. Changes beyond the agreed scope are billed at our standard rate or by separate quote.
3. Deposits & payment
Projects begin once a deposit is paid via PayFast. Deposits secure development capacity. Final balances are due before site launch unless otherwise agreed.
4. Hosting
Hosting is billed monthly or annually in advance. We provide 99.9% uptime on a reasonable-efforts basis. Scheduled maintenance is excluded.
5. Intellectual property
On full payment, you own the final deliverables. Nexsus retains rights to underlying frameworks, libraries and reusable code.
6. Confidentiality
Both parties agree to keep non-public business information confidential.
7. Liability
Our liability is limited to fees paid for the affected service in the 12 months preceding the claim. We are not liable for indirect or consequential losses.
8. Governing law
These terms are governed by the laws of the Republic of South Africa.
